The genetic profile of the semen found matches that of the DNA provided by the footballer. The Brazilian football star Dani Alves is facing new problems due to the results of a vaginal area smear from the 23-year-old woman who reported being sexually assaulted at a Barcelona nightclub in December 2022, which matches Alves's DNA. According to the prosecution, which leaked these results to the press, this confirms that Dani Alves is still lying and that the latest version he gave of the events on December 30th - already his third version - is also not true.

The footballer, who is still in prison accused of serious sexual assault in one of the toilets in the private VIP area of the Sutton nightclub on Barcelona's Carrer Tuset, has been changing his version according to the evidence that has come to light, the latest being this coincidence of the DNA that the newspaper El Periódico reported. First, the former Barça star who was visiting Catalonia over the Christmas period claimed that he knew nothing about the woman who made the complaint; then he acknowledged meeting her but said he did nothing; and then he admitted that there was sexual contact, but with consent and without intercourse - which, according to the evidence now to be included in the case, can also be ruled out.

None of the versions Alves has offered match the facts

The footballer's most recent version is that, after the two parties consensually agreed, the woman gave him a fellatio. The DNA tests, which have located the footballer's semen on the woman's clothes and also on her body, in the vaginal area, contradict this third version and appear to confirm that Dani Alves penetrated the 23-year-old.

The footballer's defence lawyer continues to maintain that the sexual activity was consensual, but what is clear from the DNA tests and the finding of the footballer's semen in the vaginal smear, is that it was not only fellatio that took place, as Alves affirms. During the investigation, and above all, during the trial, despite the changing accounts and the possible lies, what will have to be proven is that the sexual activity was against the woman's will and that, therefore, Dani Alves raped her, as the prosecution and the woman maintain. Be that as it may, these new tests, which relate four biological remains analyzed - on the woman's body and clothes, and in the toilet of the VIP area - make the footballer's defence even more complicated.

Pending bail decision

The reports on the DNA found in the woman's vaginal area have already been presented to the investigating court as well as that of a more senior tribunal, the Barcelona Audience, which has to decide on whether or not to accept the bail request made by Cristóbal Martell, Dani Alves's lawyer. Martell submits to the court that the 49-year-old Brazilian footballer will not attempt to flee and will place himself at the disposal of justice throughout the investigation of the case. On the other hand, the Spanish public prosecutors and the woman's own lawyer want nothing to do with this bail proposition. They want Alves to remain in prison throughout not only this phase, but until there is a final verdict in the case, to prevent him from leaving Spain and avoiding responding to justice for the alleged sexual assault.
